1. Inspection and Warranty
1.1 The Hirer acknowledges that they have inspected the product on delivery and confirm that it is clean and in good working order.
1.2 The Hirer understands the intended and proper use of the product and agrees to use it safely and responsibly.
1.3 Prime Physio Essentials provides no warranty beyond the manufacturer’s standard warranty supplied by the original equipment manufacturer.
1.4 Prime Physio Essentials is not responsible for the suitability of the product for any specific clinical purpose, patient type, or required therapeutic outcome.
2. Charges and Terms
2.1 The Hirer agrees to pay the following charges:

Delivery and Setup Fee: Payable before delivery.

Rental Charges (billed monthly): no lock-in option or lock in monthly option
2.2 All rental payments are billed automatically through Stripe.
2.3 The rental period begins on the delivery date and continues until the treadmill is returned to Prime Physio Essentials or the Hirer completes the buyout payment.
2.4 If the Hirer requests pickup at the end of the rental, a pickup fee applies.
2.5 This hiring agreement is personal to the Hirer and may not be transferred or assigned to any other business or individual.
2.6 Rental agreements automatically continue month-to-month beyond the minimum term unless cancelled or the treadmill is bought out.
2.7 Hire charges continue until the treadmill is physically returned to Prime Physio Essentials or the buyout is fully paid.
2.8 The Hirer may not sub-hire, lease, loan, or otherwise transfer possession or use of the treadmill to any third party.
3. Buyout Option
3.1 The treadmill may be purchased by the Hirer at any time.
3.2 The buyout amount is calculated as:
Retail Price minus all rental payments already made.
3.3 The buyout must be paid through a one-off invoice issued by Prime Physio Essentials.
3.4 Once the buyout invoice is fully paid, ownership transfers to the Hirer.
3.5 No returns or refunds are permitted after ownership transfers.
4. Maintenance and Breakdown
4.1 The Hirer must keep the treadmill clean, safe, and in good working order at all times.
4.2 All repairs must be carried out only by the product manufacturer's technicians or a technician approved by Prime Physio Essentials.
4.3 The Hirer must notify Prime Physio Essentials of any breakdown within 24 hours.
4.4 Prime Physio Essentials does not supply replacement units during repair periods.
4.5 Misuse, accidental damage, electrical damage, or improper operation is the responsibility of the Hirer.
4.6 The Hirer must comply with all workplace health and safety laws, clinical safety standards, and manufacturer instructions when using the equipment.
5. Loss, Damage and Cleaning
5.1 The Hirer is responsible for the treadmill from the moment of delivery until it is returned or bought out.
5.2 The Hirer must compensate Prime Physio Essentials for:

Any damage beyond fair wear and tear

Any missing parts
-
Any cleaning required to restore the treadmill to hire condition

The full replacement value if the treadmill is lost or stolen
5.3 These charges may be invoiced separately or deducted from the buyout credit, at the discretion of Prime Physio Essentials.
6. Location, Removal and Returns
6.1 The treadmill must remain at the delivery address unless Prime Physio Essentials grants written permission to relocate it.
6.2 The Hirer is responsible for the safe return of the treadmill at the end of the rental period.
6.3 For returns, the Hirer pays the pickup fee for collection. If the Hirer fails to return the treadmill after rental termination, the equipment may be treated as unlawfully retained property and recovery action may be taken.
6.4 The Hirer is solely responsible for returning the treadmill to Prime Physio Essentials unless a paid pickup is arranged.
7. Indemnity
7.1 The hirer hereby indemnifies and holds indemnified the owner from and against all claims, action suits, demands, costs and expenses, including all legal costs and expenses, in any way arising out of the use of the goods between the commencement of the hire and the return of the goods to the owner, whether caused by negligence of the hirer, his servants or agents or by the negligence of any other person whatsoever or arising out of the condition of the goods or of the use to which they are put or otherwise whatsoever.
8. Payment Default and Termination
8.1 If a rental payment fails, the Hirer has 48 hours to update their payment details.
If payment is not resolved within this period, Prime Physio Essentials may terminate the agreement and recover the treadmill without further notice.
8.2 Prime Physio Essentials may terminate this agreement at any time by giving the Hirer two days notice. Prime Physio Essentials may also terminate the agreement immediately if the Hirer breaches any term of this agreement, including but not limited to:

Failure to make payments

Misuse or unsafe operation of the equipment

Moving the equipment without permission

Failing to maintain the equipment
-
Refusing inspection or access

Returning the treadmill in damaged condition
8.3 If this agreement is terminated for any reason, the Hirer authorises Prime Physio Essentials, its employees, or authorised agents to enter the premises where the treadmill is located to search for and recover the equipment.
This right applies even if entry requires accessing private or commercial premises occupied by the Hirer.
Rental charges continue until the treadmill is physically recovered or returned.
8.4 Prime Physio Essentials is not liable for any loss, damage, or inconvenience caused during the retrieval of the treadmill following termination, whether arising from equipment condition, access to the premises, or recovery process.
8.5 If the Hirer does not return the treadmill after termination or after a lawful request for return, Prime Physio Essentials may treat the equipment as unlawfully retained property.
Legal action may be taken to recover both the treadmill and any outstanding rental charges, replacement costs, or associated expenses.
8.6 The Hirer remains responsible for all rental charges up to the date the treadmill is returned or recovered.
If the treadmill is lost, stolen, or withheld, the Hirer is liable for the full replacement value in addition to rental charges accrued until the date of replacement payment.
